The High Court, The Crown Court and Magistrates Court Essay

The High Court, The Crown Court and Magistrates Court - Essay Example As district judges are legally trained, they can work through case quicker, and have better technical and legal knowledge(Daryl Williams, 2001, p.146). Lay Magistrates can also be referred to as 'justices of the peace'. The Lord Chancellor appoints JP's. This is officially done beneath a document called 'commission of the peace'. This is carried out in two ways. moreover in respect of counties, where it is beneath the advice of the lord lieutenant of the county and help by the advisory committee, or in respect of urban areas. In this case, it is on suggestion of the advisory committee only(Anthony Blackshield, 2000, p.428). No doubt, these committees were kept clandestine, until 1992, but have since been re-published so that all names are renowned. The Lord Chancellor has to take into account that the panel has a wide-cross part. This means that there be supposed to be a diversity of dissimilar people from dissimilar ethnic and social backgrounds. This is to make sure that the panel of JP's is delegate of all possible defendants, and all feature of society(Michael White, p. 152). In order to become a JP, it is important to be reliable and committed. The lay people must either live or work, within a 15-mile radius of the area being scrutinized on behalf of the defendant. JP's must also be able to sit in court for a minimum of 26 sessions-one session making up one half day. The lay people are not paid, therefore they are reimbursed for loss of earrings, travel expenses and lunch etc. it is vital for lay people to be aged between 21 and 65, although there are not may 21 year old JP'S and the youngest age usually ranges from 26-27. This is due to lack of life experience. Above all it is important for the potential JP'S to not have a criminal record this refers to bankruptcy, theft, tax etc(Enid Campbell, 2001, p.95). Critical Analysis Of The Use Of Magistrates Courts There are lots of advantages of having lay magistrates. As they are not paid, the government save money. The magistrate's court is therefore contemptible to run. It would be extremely luxurious for the courts otherwise, to hire legally trained judges. The magistrates are usual people. They have understanding of the kind of live the defendants have. This variety of people shows that there is more of a representation (Cracknell DG). The judiciary is made up of a wider cross-section. 45% are women. though there are not numerous ethnic minorities there are still a vast amount, and the numbers are rising. The magistrates also get hold of local knowledge. As they live inside 15 miles of the area, they know what the circumstances re like, and they are aware of certain difficulty so they can empathize with the people(Anthony Blackshield, pp.427-28). There are also some disadvantages to. Sometimes, as the lay people are described as being 'middle class, middle aged and middle minded' they do not always cover a very wide cross-section of the real, for example if there was young defendant on trail, the older lay people wouldn't be able to fully understand him, and his thought and feeling (Zander M). This would be bad, as the younger people would be treated unfairly. There will be little common with the younger defendants and the older lay magistrates. Although a

English Paper - Essay Example This can be forced or voluntary and can often have severe effects on the minority culture. Such effects may include the loss of unique traditions and or other cultural aspects. The assumption that assimilation may be considered necessary or even desirable demonstrates an ethnocentric view of the minority culture – that is, that they are judged according to the standards of the dominant culture. In the case of the Australian Aborigines, assimilation was initiated largely as a result of such ethnocentric views, as will be explained. The British colonists who arrived in Australia towards the end of the 18th century saw the Aboriginal people and their lifestyle as lazy and degenerate. Partly due to the unpredictable climate of their environment, the Aborigines had long ago chosen not to adopt an agricultural style of subsistence, instead opting for a hunter-gatherer lifestyle. (Clarke 17) As a second consideration, agriculture is more demanding than the hunter-gatherer lifestyle, because cultivation and animal husbandry take up significant amounts of time. It never occurred to the British settlers that the natives had chosen their lifestyle for specific reasons. They simply saw the Aborigines as lazy people because they did not work all day. This label has persisted in the national consciousness of Australia and is still not completely eradicated in the present day (Clarke 18). Lingering attitudes such as these indicate that the incomplete understanding that began in the 18th century is still a part of modern Aus tralia. In the nineteenth century the welfare of the natives was not an issue in the minds of settlers, and they were often exploited as well. The following passage highlights not only practices of kidnapping and mutilation, but also the prevailing attitude of the settlers towards the natives: Aboriginal men and women were routinely kidnapped to

Is the Anglo-American special relationship an equal relationship Essay

Is the Anglo-American special relationship an equal relationship - Essay Example The term had its roots in the shared values, common language and historical experiences. The term provided that the two countries were to collaborate in the fight against a common enemy and pursue of common objectives together. The Anglo-American co-operation also discouraged the American manipulation of the British economic weakness. It also helped to manage the mismatch between Britain’s overseas capabilities and commitments. The Anglo-American treaty meant that US was to tolerate the British discriminatory practices such as support for British established overseas interest, the sterling Area and allow the British policy makers to abandon their unsustainable territories without US viewing Britain as a weak country (Dorey 2005, p.73). The aspiration of the Anglo-American relationship seemed unrealistic after the Second World War. This was because of the loan given to UK by US during the Second World War, severe differences over the Palestine question, the unbridled pursuit of international free trade by US, and betrayal in the nuclear research. The reaffirmation of the special relationship between the two countries enabled Britain to regain some of its lost influence in Washington. The relationship created opportunities to for UK to harness Americans powers. the British and US took a central role in the structuring of post war international order by creating institution such as the UN security council, the Bretton Wood system, the NATO and the GATT. The mutual economic interdependence strengthened the partnership between UK and US. For example, the sterling become the reserve currency for the Bretton woods system, America surpassed Australia as the British biggest export market in the year 1956. The Anglo-American economic relation was also crucial in the subordination of the multilateralism enforcement to the western world by US (Dorey 2005, p.74). The central agenda in the Anglo-American co-operation was the defense alliance, which involved the sharin g of military technology and intelligence. For example, the US Atomic Energy act restored the nuclear relationship curtailed by the McMahon Act. Britain also accessed the US key to controversial bases and facilities in the homeland and the Polaris submarine base (Dorey 2005, p.74). Britain also benefited a lot from the Anglo-American relationship during the cold war. America provided several economic relief and the Britain transferred unsustainable territories of Greece and turkey. This was important for the two nations as US was British greatest friend and it helped to maintain the impression of the Anglo-American solidarity. America was the power capable of supporting the British interest, and Britain’s international status relied on the American willingness to treat Britain as a partner in their relationship (Dorey 2005, p.74). The Anglo-American relationship played a crucial role in Britain’s international policy during the Second World War. During this period, Bri tain needed to win US sympathy and material aid so as to survive, especially after the fall of France in July 1940. After 1940, the propaganda about Britain’s ailing economy spread in North America. This made Britain seek financial aid from US president, Franklin Roosevelt in the form of a ‘lend’ lease programme to finance it war programmes (Addison

International Finance and Law Assignment Example | Topics and Well Written Essays - 750 words

International Finance and Law - Assignment Example A close analysis of these two descriptions of the same product provides two different products. In the first document, it is evident that the traders are dealing with steel ingots, while in the second document; we cannot deduce which products the traders are dealing with. The only thing we are sure of, as a bank is that they are dealing with ingots. I would not honor the Letter of Credit, and as such, would not make any subsequent payments towards the document. This is because the document speaks of a product that is completely different from the one in the contract of sale. Consequently, the bank would be liable for honoring a Letter of Credit that has such form of discrepancies, and as such, would be liable to pay any amount of liability caused by the damages incurred from this contract. Furthermore, it would be difficult for the bank to trace the money paid out to SS, if at a future date the traders realized the discrepancies in the two contracts and demand to stop the contract, especially if at all he is a fraudulent person. Honoring the contract also gives him legal rights to decline liability to the contract, and he may choose not to send the products at all, or send a different product, ingots instead of 51 steel ingots to the buyer (Bamford, 2011) By refusing to honor this Letter of Credit, I would have to ask both parties to the contract to review the details of their contract. I would demand that they make changes to the contract and rectify the discrepancies before the bank can release any payment upon the order made. For instance, I would send a letter to MM advising him of the difference in description of the goods between the Contract of sale and the Letter of Credit. This means that the goods that the letter of credi demands payment upon are not the same ones discussed in the contract of sale. Therefore, he needs to clarify which goods he is paying for, and what is the acceptable market price of these goods. It might also

Method of Data Analysis Essay Example for Free

Method of Data Analysis Essay The researcher made use of SPSS version 15. 0 to be able to compute for the statistics required. For the degree of importance and actual performance of Body Shop, the descriptive statistics of means, standard deviations, and frequency distributions were generated. The Pearson product moment correlation coeffiecients were likewise computed; the bigger is the magnitude of the r-value, the stronger is the relationship between two variables. The sign denotes the direction of the relationship – that is, whether they are directly or inversely proportional (Salkind 2000). 3. 1 Conclusion. The present study purposively selected 150 respondents for its telephone interviews. Secondary data were the basis for the literature review and the design of the questionnaire. The latter was both face and content validated. 5 respondents were used to pilot test the instrument to ensure clarity of questions. SPSS 15. 0 was used for the statistical computations. ? Chapter 4 Results and Discussion 4. 1 Introduction This chapter presents the statistical results gathered from the survey questionnaires, and a substantive discussion of these results, culling from the literature in Chapter 2. 4. 2 Results Table 2. Gender: Frequency and Percentage Breakdown. The table shows that all of the respondents were female, accounting for 100% of the sample. Table 3. Age: Frequency and Percentage Breakdown. When asked about their age, majority of the respondets (42. 7%) answered that they were between 21-25 years old. This is followed by the 26-30 years old category (36. 0%); 31-35 years old at 10. 7%; then by 20 years old and 35-40 years old both at 5. 3% Table 4. Have You Purchased a Body Shop Product in the Past 12 Months? All of the respondents likewise expressed that they have purchased at least one Body Shop product over the past 12 months. Table 5. Means and Standard Deviations: Importance of Factors which Affect Cosmetic Product Choice. When asked to rate the importance of the factors that affect their choice of cosmetic products, the items were rated as follows, in descending order: the degree to which the product is environment-friendly (X= 4. 52, sd=. 59); the customer service of the store personnel (X=4. 32, sd=. 65); the sales promotions used for the product (X=4. 31, sd=.65); the values espoused by the company who sells the product (X=4. 16, sd=. 67); Having a globally renowned brand name (X= 4. 16, sd=. 59); trendiness or fashion sense represented by the product (X= 4. 11, sd=. 64); recommendations or positive feedback I garner from my friends, family and acquaintances (X=4. 05, sd=. 68); competitive price of the product (X= 4. 05, sd=. 61); the degree to which the product espouses â€Å"natural† rather than artificial (X=4. 00, sd=. 66); quality of the products (X=3. 88, sd=. 71); the convenience of going to the store location (X=3. 84, sd=.59); the variety of product offerings in the store (X= 3. 59, sd=. 59); Attractiveness of the packaging (X=3. 21, sd=. 52); information on the product’s label (X=3. 17, sd=. 80); and media advertisements of the product (X=2. 73, sd=. 86). Table 6. Means and Standard Deviations: Actual Performance of Factors which Affect Cosmetic Product Choice. On the other hand, when the respondents were asked to rate the actual performance of Body Shop through the same factors, the following are the results in descending order: the degree to which the product is environment-friendly (X=4.57, sd=. 49); The customer service of the store personnel (X=4. 48, sd=. 60); the degree to which the product espouses â€Å"natural† rather than artificial (X=4. 37, sd=. 58); the values espoused by the company who sells the product (X=4. 37, sd=. 67); having a globally renowned brand name (X=4. 20, sd=. 69); quality of the products (X=4. 14, sd=. 74); recommendations or positive feedback I garner from my friends, family and acquaintances (X=4. 11, sd=. 78); the sales promotions used for the product (X=4. 05, sd=. 75); the convenience of going to the store location (X=3. 94, sd=.60); Trendiness or fashion sense represented by the product (X=3. 90, sd=. 72); the variety of product offerings in the store (X=3. 79, sd=. 52); competitive price of the product (X=3. 63, sd=. 70); attractiveness of the packaging (X=3. 58, sd=. 49); information on the product’s label (X=3. 36, sd=. 66); and media advertisements of the product (X=2. 73, sd=. 85). Table 7. 1 Paired Means and Standard Deviations of Factors. Table 7. 2. T-test Results of Pairwise Comparisons of Importance and Actual Performance. The following pairwise comparisons are significant at the . 01 level: Quality of the products (t=-5. 92, p=. 00), the customer service of the store personnel (t=-3. 85, p=. 00); the variety of product offerings in the store (t=-6. 23, p=. 00); the convenience of going to the store location (t=-4. 07, p=. 00); attractiveness of the packaging (t=-7. 69, p=. 00); the degree to which the product espouses â€Å"natural† rather than artificial (t=-6. 12, p=. 00); the values espoused by the company who sells the product (X=4. 37, sd=. 00). In all these items, Body Shop has exceeded the degree of importance attached by the respondent on the factor. In contrast, the following factors are those in which Body Shop did not quite meet client expectations based on the degree of importance they have assigned to each: competitive price of the product (t=8. 66, p=. 00); trendiness or fashion sense represented by the product (t=3. 73, p=. 00); and the sales promotions used for the product (t=3. 98, p=. 00). There are no significant differences on the following items: brand (t=-. 816, p=. 416); the degree to which the product is environment friendly (1. 465, p=. 145); and positive feedback garnered from significant others (t=-1.070, p=. 287). These suggest that Body Shop has met expectations of the respondents based on the degree of importance they have attached to each factor. Table 8. Correlations among Patronage of Environmental Friendly Products, Social Responsibility of a Company, Patronage of Products and Companies that Care for the Environment, and Overall Satisfaction on Body Shop. The correlation results show that patronage of Body Shop products because of their being environment friendly is significantly correlated with their being a socially responsible company (r=. 397, p=.00). This means that patronage of Body Shop products increases as well with positive perceptions of their company as being socially responsible. Moreover, such patronage is also positively and significantly correlated with their expressed support for companies that espouse care for the environment (r=. 533, p=. 00). None of the statements were significantly related to overall satisfaction of Body Shop products, which suggests that there are other determinants of satisfaction apart from espousing environment friendliness and corporate social responsibility.
